NEW DIMENSIONS OF BJK DISPUTE CREATED BY EUROPEAN UNION, ABOVE 98% APPROVED
– BARONESS EMMA NICHOLSON REPORT
CLEARING CONFUSIONS AND PRESENTING DEDUCTIONS SO THAT BENEFITS CAN BE ACCRUED FOR THE OPPRESSED PEOPLE OF JAMMU, KASHMIR AND BOLOR ON BOTH SIDES OF THE DIVIDE
In the under mentioned paras, we have tried to precisely and concisely cover some salient aspects of the most important updated international document on Gilgit-Baltistan and Jammu-Kashmir in the form of Baroness Emma Nicholson report. Now, we should do our homework to befittingly receive the ensuing practical actions of this report for the benefit of our people and to ensure unification and forging amity between various regions, classes, religions, sects and races of the disputed former State.
1. Misrepresentations and Clap Traps.
a. Difference between preliminary and final report and attitude of MOFA.
The 44 paragraph report was initial preliminary draft report and not the final report approved now by EU parliament, after being approved by EU Foreign Affairs Committee. There is no mention of rights for homosexuals in this report as wrongly described by MOFA (Ministry of Foreign Affairs Govt of Pakistan) spokeswoman on 28 May 2007. The MOFA is time and again getting its fingers burnt on Gilgit-Baltistan issue of the BJK dispute. They should be simply ashamed of themselves and apologize to the people of Gilgit-Baltistan for compounding confusion and denying them their basic fundamental human rights.
b. UN Resolutions and obstructions in its implementation. The MOFA spokeswoman has again misrepresented and compounded confusion by stating that this report has not taken into account UN Resolutions. She has also cleverly tried to disassociate MOFA from Brussels based Pakistani ambassador’s ill-timed and jerky official letter to EU on “Gilgit-Baltistan” issue of Bolor, Jammu and Kashmir dispute. The last minute summersault of the MOFA representative in Brussels has infact catalyzed Bolor issue of the BJK dispute; manifold. It is very obvious that the spokeswoman or those behind him have even now not read the report.

c. Regard for UNCIP and UN Resolutions.
Baroness Emma Nicholson report was authorized on 15 Dec 2005. It has taken into account all UN Resolutions on the dispute with effect from 38/17 Jan 1948 to 307/21 Dec 1971 and all other UN charters, declarations, Simla and Tashkent agreements agreed under UN charter because of linkage of Gilgit-Baltistan and J&K with UN / UNCIP, being disputed conflict zone areas. All necessary turbulent events happening in Pakistan, Gilgit-Baltistan and J&K; logically should have been taken into consideration so as to show that what sort of wicked, cruel, illogical, illegal, self centered and shameless colonial system is operative in Gilgit-Baltistan (POB – Pakistan Occupied Bolor) and POJK (Pakistan Occupied Jammu Kashmir) under the rulers of Pakistan. The heinous crimes and horrendous acts of misrule by the Muslim rulers of the Islamic Republic of Pakistan in Gilgit-Baltistan; covered up mostly by fanning sectarianism and curbing religious freedom and in POJK, the sham relief efforts after devastating earthquake have rightly been taken into account in this report. The Indian atrocities in Indian Occupied J&K, have also been fully exposed. The 12th May 2007, Karachi mayhem, perhaps has been referred by Baroness Emma Nicholson in her briefing to EU Parliament and nobody is sure at this stage that whether there is a written mention of this in her final approved report or not.
d. Who is responsible for halting UNCIP implementation work? In the context of UN halted efforts towards resolution of the J&K dispute; the report rightly states that for holding plebiscite, the UN laid down conditions have not been and can no longer be fulfilled by the Govt of Pakistan. The part-1 of the basic UN Resolutions is Ceasefire, which came into effect on 1 Jan 1949. The subsequent overlapping stages or parts were Demilitarization and then Plebiscite. Part-2 got halted after reluctance and hesitation of the then Govt of Pakistan to take away unwanted militants and completely withdraw all non local forces from Gilgit-Baltistan and POJK. Plebiscite was to be held after Demilitarization. Is Govt of Pakistan ready to demilitantize and then demilitarize Gilgit-Baltistan (POB) and POJK (so called AJK), so that implementation on UNCIP Resolutions can be held?

e. President Musharraf’s visit to EU Foreign Affairs Committee. The report has also taken into account, the visit of President Musharraf to Foreign Affairs EU Committee on 12 Sep 2006, i.e. much after authorization of this report on 15 Dec 2005. The report amply deplores the continuing worsening of political and humanitarian situation in all parts of the former State of J&K. What is meant by pro India or pro Pakistan? In Gilgit-Baltistan, India is not perpetuating cruelty. Similarly, in Indian Occupied J&K, India is to be held responsible for atrocities but Pakistan is more responsible for instigations based on selfish short term interests without caring for consequences for the enslaved people of Jammu and Kashmir. It is involved in covert operations to instigate insurgency but has never ever resorted to dedicated overt military operations in Indian Occupied J&K. A necessary stage when an insurgency is instigated anywhere. Pakistan’s overt military operations are confined against its own non Punjabi and now non Mohajir civilian Muslim populations in Sindh, Balochistan, Frontier Province and Gilgit-Baltistan. Govt of Pakistan has always betrayed and exploited the people of Indian Occupied J&K for its own interests and not theirs. Baroness Emma Nicholson talks about reunification of all parts of the former State in a gradual practical manner. Who are the elements, who oppose it?
2. Religion as a binding force in Gilgit-Baltistan and J&K.
Any particular religion cannot be a binding force in a futuristic Union, Confederating or Federating States of Bolor, Jammu and Kashmir; merely because of the fact that safely above 20% of total population is Hindu, above 75% is Muslim and above 3% is Christian, Sikhs or Budhists. The common pure and universal teachings and values of all religions can be a binding force but not the name of any religion. We, the people of Gilgit-Baltistan will hate anyone using the sacred name of Islam to perpetuate all unIslamic practices. The Hindu Dogra and Christian English rule was thousand times better than the misrule and colonization of the Islamic Republic of Pakistan. Mosques and Imambargahs were never fired upon and shut down by security forces, religious processions and rites are always hindered, objected and fired upon. There is always pressure to remove religious signs etc, so that a sectarian climate always hungs around. The top military and civil non local bureaucracy in Gilgit-Baltistan resorts to fake sectarian dramas to earn good reports, essential for their higher promotions. There is open official sectarian discrimination in all walks of life. The officers of supreme Intelligence agency of Pakistan claim that they have been successful in converting atleast 30% of the Muslim population of Indian held Kashmir from a major sect to their likened sub sect. This is their true spirit of Islam, which has miserably failed in Afghanistan, Kashmir and has globally harmed the reputation of true Islam. We suggest an Ideological Council in future setup of the reunified disputed regions with veto power with all religions and sects against their unwanted legislation to be approved by Legislative bodies. Everyone in Gilgit-Baltistan is fully aware of the fact that sub sectarian so called jehadi mechanism in Gilgit-Baltistan was fully used to fuel sectarianism.
3. Distinct Identity of Gilgit-Baltistan other than J&K.
a. Sensitivity to Bolor Identity.
Baroness Emma Nicholson has fully catered for this aspect in her report. We are wary of the supreme Intelligent political leadership of Indian Occupied J&K and hate the artificial Govt and supreme Intelligence political leadership of Pakistan Occupied J&K. Infact, the artificial Govt of J&K at Muzaffarabad (POJK), with authority only over 5% of the total disputed regions has proved to be an Israel of Middle East for Kashmir. Only the decade old nationalist leadership of POJK, alongwith Kashmir diaspora abroad has meaningfully interacted with us for mutual beneficial goals. We have been warning before and are doing it again to resist temptations of erasing the distinct political identity of Bolot. It will be counter productive for both. Over the last 60 years, much has changed, due to isolations, machinations of govts and wrongdoings of some Kashmir origin people in Gilgit-Baltistan, who have been in league with occupiers to the detriment of sacred long term goals. Climatically and geographically, Bolor region remains cut off from Kashmir Province for almost half of the year i.e. Zojila pass, Tragbal pass, Sten Marg pass, Shuntar pass.
b. Imposition and Removal of Dogra Rule i.e. 1st August 1947 to 1st November 1947 and to 1st January 1949. The 1st Nov 1947, Islamic Republic at Gilgit for Bolor region / UN recognized local authority govt, West of Ceasefire line (now LOC – Line of Control) and as the Northern Area Province (one out of three) of the State of J&K.
Beyond doubt on 1st Aug 1947, we became the “Third Northern Area Province of the State of J&K” and came under the direct Dogra rule in real sense of the term with significantly reduced British influence, but it is to be kept in mind that exactly after three months, the people of Bolor under the leaders of Bolor, overthrew the Dogra Rule on 1st Nov 1947, and went outwards on a liberation spree and got rid of all occupational forces till Ceasefire on 1st Jan 1949. In this process not only the region of ancient Bolor or the Third Northern Area Province was Liberated but also vast areas of Kashmir Province (Kishn Ganga / Neelum valley, Gurez valley, Lolab valley) and NWFP of Pakistan (Chitral and Kohistan; though part of Bolor) were also liberated without any outside help. Thus from 1 Nov 1947, till 1 Jan 1949, Dogra regime of J&K was not there. Unfortunately, the Pakistanis, who entered in Bolor with evil intentions in the sacred name Islam, Pakistan and Jehad-e-Kashmir; pushed back the area into pre 1st Aug 1947, position. The Govt of Pakistan is allergic to this truth and we are allergic to their Mirs of Hunza and Nagar accession theory, now thanks God! discarded by the civilized European World. The people of J&K should build upon realistic rapport and meaningful interaction with us. They should not misuse the name of Kashmir to enslave, exploit or dominate us.
c. Exchange of the Srinagar, Gilgit and Muzaffarabad Governments. Will the people and leaders of Pakistan Occupied Muzaffarabad and Indian Occupied Srinagar Govts be ready to exchange their form of Govts with our worst from of Paki Govt at Gilgit? Who would not like to have the govt structure at Muzaffarabad, with real UN given powers, shed away to the Govt of Pakistan by the very sub standard, self centred and sub human Pakistan lackey political leadership of so called AJK. There can be a meaningful long term rapport, which can be established between the people of Bolor and J&K, if the political leadership and intellectuals of J&K start asking that Gilgit-Baltistan portion of Bolor be brought at par with the other disputed regions before the resolution work of the dispute can be undertaken.

Thanks a lot! for instigating a very useful debate and also for endeavoring in getting the EU in adopting a new updated approach towards the disputed regions. This approach is realistic, broad based, durable and long lasting. It is in conformation to the characters of noble gentlemen and ladies, unlike the character of Maj Brown, Sitara-e-Pakistan. The old approach is gone with the wind and has definitely served for enough time with the Sitara-e-Pakistan. The Mirs accession business has also gone outdated, to the utter surprise and embarrassment of MOFA (Ministry of Foreign Affairs), Islamabad and old ISI think-tanks on Kashmir like Brig (R) … of Kashmir origin, who should be now send home as he has sucked and fucked enough of Kashmir. The hidden agenda of supreme Intelligent political leadership of J&K is not to talk about Gilgit-Baltistan and also not to study and analyze the basic mechanics of dispute. They are like talking parrots.
5. Thanks to IKA leadership, Dr Shabbir Chaudhry and others. The Gilgit-Baltistan issue in Lady Emma report started with just two sentences in only two paragraphs out of forty-four. We pointed out at that time that it is like the tip of an iceberg or like first drop of rain in international scenario. Dr Shabbir Chaudhry is a capable, visionary and bold Kashmiri nationalist. He is open minded and straight forward; thus easy to deal with. He talks about religious freedom in Gilgit-Baltistan. IKA leadership including Nazir Gillani Sahib, Mr Mumtaz Khan, Abbas Butt, Jamil Maqsood, Sajid and many others observe thanks and shabash.
6. Right of Self Determination in Emma Report.
It is ironic and sad that major portion of the political leadership and intellectuals in disputed parts of Bolor, Jammu and Kashmir are not aware of the UN doings so far. Before plebiscite, demilitarization is to be staged with complete Pakistan Army going away from Gilgit-Baltistan and POJK, this is to be synchronized with withdraw of bulk of Indian army from 10JK. Before this, non local militants have to withdraw from Gilgit-Baltistan and POJK. After militarization, plebiscite is to be held with only two opinions for the people of BJK i.e. either join India or join Pakistan. We want to inbuild the third opinion in UN resolutions in Chapter 7 category i.e. Independence of three identities in a form they choose. Now! Beyond any doubt Gilgit-Baltistan is to be brought at par with the two other Govts functioning in disputed regions at Muzaffarabad and Srinagar before resolution of the dispute. The Govt of Pakistan should take a positive initiative now, by accepting to bring Gilgit-Baltistan at par with other disputed regions, withdrawing militants, demilitarization and insertion of third opinion into the UN plebiscite phase. India, should respond positively. The ball was and is now visibly in Pakistani court.
7. Eu in Collaboration with UN must initiate very Effective and Vigilant monitoring systems in Gilgit-Baltistan. The effects of 2004, violence mentioned in the report are continuing. Gilgit city and adjoining areas are in siege condition. Schools are officially turned into jails. Hundreds of innocent prisoners are languishing in jails and hundreds are on the run. In order to pass from Gilgit city, one has to undergo body search for a dozen times. In Oct 2004, elections were held by supreme Intelligent people to plot killings of important people and further fuel their wanted violence on required and designed lines. Any election there without clearing the mandate is useless, counterproductive and enmeshes local population into piling up of the difficulties just for nothing. Making examples of some high profile evil colonial rulers is important. The Govt of Pakistan officials are the best in the World as far as hoodwinking and appeasements are concerned. The important and powerful neighboring countries of Bolor, Jammu and Kashmir must harmonize, coordinate and initiate measures for the benefit of all, otherwise, a deadlock can again reign for a century and the golden opportunity created through Baroness Emma Nicholson report can be tragically lost.
